Third World Dependency on First World

ECONOMIC GROWTH: A COMPELLING MOTIVE TO DEPENDENCY â€Å"Is Third World dependency on First World development, practices, and funding avoidable? † By Michael John A. San Roque ABS681M G01 Submitted to: Dr. Ma. Elena Chiong-Javier October 9, 2012 Countries of the world have been sharply divided along development. Countries that are economically buoyant, technologically advanced, and politically stable are termed ‘Developed Countries’ or ‘First World’.On the other hand, countries that are technically and economically backward and are world market’s suppliers of primary commodities are tagged ‘Developing Countries’ or commonly referred to as ‘Third World’ (Aluko & Arowolo, 2010). During the post-world war and until now, Third World countries depend greatly on First World in order to restore and improve their agricultural, technological, political, and economic conditions which are apparently known as development (Patterso n, 1999).This development has connoted at least one thing: to escape from the undignified condition called underdevelopment (Esteva, 1992). No country would say that she doesn’t want development to occur in her lands. Third World countries are â€Å"nothing that wants to be something†. It is, therefore, proper to say that Third World dependency on First World development, practices, and funding is not avoidable. This paper would present the evidences that would support the above notion.The evidences are based on the inevitable support given by Developed Countries in the form of foreign aid, technological, political, and economic advancement that the needy countries lack. Foreign Aid Foreign aid has become a focus and locus in the Third World. The Developing Countries are experiencing the different facets of development problems. First World countries offer aid through investment in the economy of the needy countries, loans, infrastructural development, funding of pover ty-reduction programs, and also through supply of military hardware at subsidised rates.One of the best examples of how a needy economy was not able to refuse a foreign aid was when the US created the The  Marshall Plan  (officially known as the  European Recovery Program,  ERP) that aided  Europe  where the  United States  gave monetary support to help rebuild European economies after the end of  World War II. That quickly revived and integrated European economies into the global economy (Remenyi, 2004). Technology Transfer Third World’s desire to minimize or eradicate the gap that separates their economy to that of the First World makes them receptive to whatever the latter does in order to advance its economy.One thing that Developed Countries have is their sophisticated technology that contributed much to the development of their industrial and agricultural sectors (Remenyi, 2004). The empirical analysis has also shown that the technological capability o f the five richest countries in the world is about 13 times better than that of the five poorest. This technological progress magnetizes the poor countries and makes them realized that if they really want to enjoy the perks of development, they must adopt the advancement in technology of the rich countries (Nazara, 2000).The importance of technology in the industrializing Indonesia’s economic development has been well established. In the era of East-Asia Miracle, the country was regarded as one of the eight economies in the region whose economic growth was founded on technical progress (World Bank, 1994). Political Ideologies The last factor that fosters inevitable dependency of Developing Countries to Developed Countries is their outstanding and influential political ideologies. The world has seen how the excellent governance and political principles brought prosperous economy to rich countries especially the United States.The liberation of countries political mind has been necessary to break the chains of underdevelopment. This has become the stimulus for the poor countries to shift from tribal forms of authority to suffrage, political parties, elected representatives, and democratization. It also paved the way for the adoption of the policy-making strategies, economic-boosting techniques, and the integration of Third World countries to global economy (So, 2011) Dependency: Contemporary Way to Economic DevelopmentThe dependency of underdeveloped countries and domination of the developed ones are reinforced as the Third World states attempt to expand their economies (Patterson,1999). In pursuit of this endeavor, the Developing Countries has opened their hands to aid, practices, and ideologies that the economically, politically, and technologically successful countries are offering making Third World dependency unavoidable. Outline Paper Title: the Common Law Tradition and Sources of Law Essay

I. THESIS STATEMENT: A. Common law is a legal system that is largely formed by the decisions previously made by courts and not imposed by legislatures or other government officials. The reasoning used to interpret this type of law is known as casuistry, or case-based reasoning. It is a strict, principle-based reasoning that uses the circumstances of a case to evaluate the laws that are applicable. Decisions that were made about similar cases are valuable, and the case in question is evaluated on the basis of past cases. The strength of the similarity among the cases, in turn, strengthens the reasoning based on them. B. The term â€Å"common law† also underlines the fact that this type of law did not originate from equity, maritime and other special branches of law. Statutes serve as brief explanations of law and therefore are not very explanatory. Codification is the process by which a statue is passed, expressed within a single document, so that it is understood within existing law rather than creating the need for new laws. C. The common-law system prevails in England, the United States, and other countries colonized by England. The common-law system is used in all the states of the United States except Louisiana, where French Civil Law combined with English Criminal Law to form a hybrid system. Anglo-American common law traces its roots to the medieval idea that the law as handed down from the king’s courts represented the common custom of the people. II. WHAT IS COMMON LAW? A. Common Law is the body of law developed from custom or judicial decisions in English and U.S. courts, not attributable to a legislature. III. WHAT ARE THE SOURCES OF AMERICAN LAW? A. The United States Constitution and the constitutions of the various states B. Statutory Law – including laws passed by Congress, state legislatures, and local governing bodies. C. Regulations created by administrative agencies (such as the United States Food and Drug Administration). D. Case law and common law doctrines. E. Secondary sources of law are books and articles that summarize and clarify the primary sources of law (i.e., legal encyclopedias, treatises, and articles in law reviews). Several SourcesConstitutional, statutory, and case law—these are your tools. The United StatesConstitution is the overriding document. It is the Supreme Law of the Land. Eachstate has its own constitution. State and federal statutes are interpreted by judgesthrough case law. These sources play in each practice area. For example,constitutional law governs searches and seizures in a criminal matter. Statutesprovide the framework for real estate transactions, and case law interprets andapplies both constitutional and statutory law. There is much to learn.| IV.CONSITUTIONAL LAW A. The Federal Constitution i. The United States Constitution, as amended, is the supreme law of the land. ii. A law in violation of the United States Constitution will be declared unconstitutional and will not be enforced. iii. The United States Constitution sets forth the powers of the three branches of the federal government and the relationship between the three branches. iv. Constitutional Rights 1. The first ten amendments to the United States Constitution are commonly known as the Bill of Rights. v. The Courts and Constitutional Law 1. The broad principles enunciated in the Constitution are given form and substance by the courts. 2. Courts Balance the Right to Free Speech a. Even though the First Amendment guarantees the right to free speech, the Supreme Court has made it clear that certain types of speech will not be  protected. 3. Free Speech and the Internet a. The Internet has raised new problems for the courts in determining how to define and apply the protections of free speech. B. State Constitutions i. Each state also has a constitution that sets forth the general organization, powers, and limits of the state government. ii. A state constitution is supreme within the state’s respective borders, so long as it does not conflict with the United States Constitution. C. Constitutional Law and the Paralegal i. Paralegals often assist attorneys in handling cases that involve constitutional rights or provisions. ii. Knowledge of constitutional law is beneficial because the authority and underlying rationale for the substantive and procedural laws governing many areas of law are found in the Constitution. V. STATUTORY LAW A. Statutes are the laws enacted by legislative bodies at any level of government. B. Federal Statutes. i. Federal statutes are enacted by the United States Congress and apply to every state. ii. Any federal statute that violates the United States Constitution will be held unconstitutional. C. State and Local Statutes and Ordinances i. State statutes are laws enacted by state legislatures. ii. Any state law that is found to conflict with the United State Constitution, or with that state’s constitution, will be deemed unconstitutional. D. Uniform Laws i. Uniform (â€Å"model†) statutes are drafted for adoption by the states. ii. A state can adopt or reject all or part of a uniform law, as the state legislature wishes. iii. An example of a uniform law is the Uniform Commercial Code (UCC). E. The Expanding Scope of Statutory Law i. Legislative bodies and administrative agencies assume an ever-increasing share of lawmaking. F. Statutory Law and the Paralegal i. A paralegal may often assist in cases involving violations of statutory law. ii. A paralegal working on cases governed by statutory law needs to know how to both locate and interpret the relevant state or federal statutes. VI. ADMINISTRATIVE LAW A. Agency Creation and Function i. Administrative agencies are created by legislatures to administer and enforce legislation and to issue rules to implement the goals of specific legislation. ii. Examples of federal administrative agencies are: 1. Environmental Protection Agency 2. Occupational Safety and Health Administration 3. Food and Drug Administration. A. Administrative Law and the Paralegal i. Paralegals frequently deal with administrative agencies. 1. Paralegals may also work for administrative agencies, drafting new rules, mediating disputes, and numerous other tasks. Consulting CasesCase law represents judicial opinions. Judicial opinions represent opinions written by judgeson a particular case. Understanding case law can be difficult. It requires analytical skills. Suchskills are acquired over time and after reading many cases. But do not despair. When you findthat perfect case, it will be worth it.| VII. CASE LAW AND THE COMMON LAW TRADITION A. The Origins and Nature of the Common Law i. Common law originated in medieval England with the creation of the king’s court. ii. Courts developed the common law rules from the principles underlying judges’ decisions in actual legal controversies. iii. Judges attempted to be consistent. When possible, they based their decisions on the principles suggested by earlier cases. iv. The practice of deciding new cases with reference to former decisions, or precedents, is a cornerstone of the American judicial system. v. Stare decisis means â€Å"to stand on decided cases.† vi. Under this doctrine, judges are expected to abide by the law as established by previous court decisions. vii. Sometimes a court will depart from precedent if it decides the precedent should no longer be followed. VIII. WHAT IS THE IMPORTANCE OF PRECEDENT TO THE JUDICIAL DECISION-MAKING PROCESS? A. The judicial process is informative, thought-provoking and often insightful, albeit verbose. It is also timely given the intense political nature of current federal judicial confirmation proceedings. Under the doctrine of stare decisis, once a court has set forth a principle of law as being applicable to a certain set of facts, that court and courts of lower rank must adhere to that principle and apply it in future cases involving similar fact patterns. Stare decisis have two aspects: first, decisions made by a higher court are binding on lower courts; and second, a court should not overturn its own precedents unless there is a strong reason to do so. IX. WHAT ARE EQUITABLE AND LEGAL REMEDIES? A. Equitable remedies are judicial remedies developed by courts of equity from about the time of Henry VII to provide more flexible responses to changing social conditions than was possible in precedent-based common law.

In R Tours, I was assigned in the Inbound Department and I learned a lot from there. One of the main duties in the department is the inbound operation. The inbound operation consists of several tasks. First to create interesting and excellent tour packages, then, promote them locally and internationally and finally handling them. We may receive request or booking by telephone, fax, letter or email from individuals, local and international groups. Most of the time a normal booking will have information on the type of tour package chosen, the length of stay, the number of people and additional services required such as a buffet set up instead of an a la carte menu or providing the welcome drink in the airport instead of the hotel. Normally we reply by thanking the person or the foreign company involves and we include all the necessary information such as the detailed itinerary, the cost of the tour and most important our confirmation for handling the tour. Then we will wait to get a confirmation from them before starting to make all arrangements and preparations. The confirmation includes the date and time of arrival, the flight number if they are arriving by airplane, names plus passport numbers of clients and the rooming list. It is only after receiving the confirmation that we begin to work on arranging and preparing the booking of hotels, restaurants, transportation vehicles, museum tickets and sometimes airlines tickets if they are intend to fly to the south of the country. We also, arrange the visas and prepare the travel insurance. We assign people who are going to take care of the group such as tour leader, tour guide and driver. Then we prepare the reservation forms and we send them to our suppliers. The reservation form includes the services requested and the number of pax and sometimes more information according to the kind of supplier. In a case of a hotel for example, the reservation form will include extra information such as the date of checking in and out, the number and what type of room and type of payment. Suppliers may be hotel, resort, motel, museum, restaurant, theme park, car rental, motor-coach company, a marina, a diving center or anything else. During peak season we have difficulties in getting the right accommodation or some other services that was mentioned in the tour package, in this kind of situation we, must think of an alternative and inform the client about the changes and finally when both of us agree we proceed with the arrangement. The next task is to handle the group from the first day to the last day. The most important rule with the western group is being punctual because they are used to it and they do not like to wait for anything or anybody even from their own group. Make sure everything goes according to the itinerary timing. All the employees and suppliers involve must take this into consideration. In case of lateness they may complaint and even ask for refund for that particular service. All the time make sure that everything is ready in advance. For example, during the arrival day, the tour guide and the motor coach must be present at the airport at least one hour before the plane lands and provide the tour guide with a small board having the name of the group to make it easier for the group to find him. We need to monitor the group every single day and keep in touch with the tour leader. All the international groups have their tour leader and building an excellent communication or relation with him or her is really important because the tour leader is the one in charge of the entire group and he or she plays a very important role to insure that the tour is conducted as planned. Carrying daily briefing with him or her helps to find out what happened the day before and if any change has to be done for the next day. In the department we need to carry meetings to resolve any kind of problem during the tour. I learned to build strong relation with our suppliers to minimize the problem and complications. In the beginning I was facing many problems of getting what I wanted and it used to take days of negotiation before getting it. I realized that certain suppliers such as five star hotels or dine dining restaurants were not responding positively to our request because they were preferring to deal directly with the customers or with reputed tour operator company. According to their opinion, we were not qualified or capable of bringing much business and I was really disappointed by their discrimination and behavior but my personal and communication skills helped me to accomplish whatever I wanted from them. It is sad to realize that they are used to work this way, they don’t easily cooperate with small companies and I needed to win their trust. Finally they decided to really do business with me and everything was working smoothly after that. I think and believe that these hotels or any other suppliers should cooperate and build a better relationship with the small tour operators in order to benefit from each other. I definitely agree that we were not in the same level as those large tour operators such as Z Tours but we proved to these hotels income as well. However, I was pleased that after many months of hard work, we were able to increase the number of bookings with them month after month. During my time spent in R Tours, I learned to better understand the procedure of handling tour packages. Now I am more confident of myself and well prepared due to all the experience that I had acquired while working there. I would like to conclude by saying that inbound operation is about using your capabilities, trying your strength in all the different tasks involves and be able to solve any problem happening during the tour by relating to your learning experience at the work place.

The centre works with the local communities to promote environmental conservation through soil conservation and reforestation. The centre therefore aims at establishing a sustainable ecosystem that benefits people and other inhabitants of the environment. ... Ecotourism generally targets the creation of awareness in people on the need to conserve the deteriorating natural resources (Wood, 2002). Ecotourism also promote the development of the local communities through promotion of economic activities that are aimed at the conservation of the natural environment and resources. Through ecotourism programs, the government is also pushing its agenda of poverty eradication through the promotion of sustainable community development projects Neth (2008). Although ecotourism has massive and notable benefits, some scholars have pointed at some disadvantages on the activity that focus on the long-term developments. Promoting ecotourism has led into encroachment into the natural environment and this has caused ecological imbalance. The process has therefore led to the destruction of ecosystems that are of great biological importance for the future generations. The need to generate more revenue has accelerated the pace of destruction of the natural environment and therefore the country would do better without the activity. Ecotourism has also exposed native communities of the country to external influence and this has promoted cultural interference (Belanger, 2006). The activity has therefore weakened the culture of the Thai people that had been one of the strongest cultures of the world. Journal Writing Essay During this class I have made two self- discoveries that will positively impact my career goals. Those self- discoveries has helped to mold, and shape me into a student that I have never thought I would be. Those discoveries were that I am an organized learner, because I made a study plan to help me determine when, and how I would study. Being that I have five children, I had to make sure that I had set a schedule so that my course work including study time would not affect my family time and take away from spending time with my children and fiance`. Since these are the competing priorities in my life right now learning to obtain trust and consistency in the home while I have been attending school has also improved because not only do I see my success so does my children and fiancà ©. Knowing that I had that support also has made it possible to do my best in school, setting the pace for them to do the same in school also, whether it be good grades, sports, etc. I know that they will continue to be good at what they do and have proven to do so time after time. Another self- discovery that I have made that will positively impact my career goals is my willpower. Willpower has become my greatest strength. Being able to control what I do, leaded to personal improvement. I realize that lack of willpower not only causes you to lose focus it also allows you to fail to achieve goals. My ability to resist short-term temptations have helped me to meet some of my long term goals already. There has never been a day that I thought that I could not achieve my goals. I kept a positive mindset just so I could keep going. Negativity takes a lot of willpower from you and I think success is a part of having a positive mindset. Having that determination was not easy at first I can say that, but having that willpower and thinking about my future will positively impact my career goals. Two self-discoveries that I believe will positively impact my personal life, o ne is my happiness. If I am not happy there is nothing good that will come out of being unhappy. In my life I noticed that unhappy people wait for something to make them happy. Happy people make themselves happy without hesitation because they choose to have  positivity surround them in all areas of their lives. I am that happy person, I do not feel like being unhappy because it drains energy, it drains potential, it sucks the life out of you, and it keeps you from becoming successful. I am happy because I am not afraid of change, I am valued, and I attend school knowing that I am a success story. I learned to create positive changes in my life. In doing so this has made a positive impact on my personal life. My character will also have a positive impact on my life. Knowing who I am, my beliefs, values, and morals. The clearer I became about what I value and what I believed in the more effective I became not only for me, but for my family, my friends, and my peers. I have this thirst for knowledge and a thirst to make the best out of any situation and this impacts my personal life in so many positive ways because when I know who I am , my children will learn their true identity because they are my children and they share the same DNA. My grandmother use to tell me that I can be different from everyone else and still be blessed and fabulous, and I believed her.So this has played a part in my self- identity. I also had to explore what my heart wanted, so that I could truly identify who I was, the most beautiful thing that could have happened to me was unfolding that I was an excellent mother, a great friend, and a superb student. Knowing these few things lead me to know who I was in the beginning and knowing this has made a positive impact in my personal life. My biggest take way from this course is keeping a growth mindset and knowing that I always have room for improvement. I want to keep ownership over my learning experience. I am in control of my success. I am able to keep this in mind and always grow with it. This is something that I had to develop because when I was younger I had a fixed mindset I did not want to change because I was set in my ways and it felt like everything I was doing had failed me, so I figured that I would quit trying and give up. One day that change I started thinking of other approaches of how to be better and I used trial and error as a way of figuring out what I needed to do. So as I was thinking and applying I realized that I had that growth mindset and I have kept it all through the years. While learning about the fixed mindset and growth mindset I gained a better understanding on what life is really about also and I saw the bigger picture. The way I perceived it to be is to  noticed that if something is not working right the way you are doing it, then try another way and if that works out better than stick with it, but have fun with it and be creative and then you will be successful that way . Life is about trial and error and never giving up no matter what.

It is a nation that plays a crucial role in U.S. foreign policy because of its strategic location and its democratic government. However, Turkey often is overlooked in the larger picture of U.S. foreign policy. Because of this, Turkey has managed to only be partially involved in major international affairs. To put it bluntly, America uses Turkey when it needs it, but other than that, Turkey is not a major priority of U.S. foreign policy. The problem with this situation is that Turkey often suffers. It can be noted that U.S. foreign policy has aided modern Turkey in several ways. However, for the most part, U.S. foreign policy has slowed the growth and development of modern Turkey. The Gulf War of 1991 left Turkey crippled, but it gained a strong relationship with the United States. Turkey played a crucial role in the first Gulf War and in post-Gulf War activities. During the 1991 Gulf War, Turkey allowed U.S. troops to operate on its soil and allowed its border to be used to wage a northern attack on Iraq (Ciarrocca). After the war was over, U.S. fighter jets used the Turkish air base, Incirlik, to patrol the UN-mandated northern "no fly" zone in Iraq (Hedges). Without Turkey's cooperation in these international affairs the campaigns would not have been as successful as they were. The Frankfurt school envisioned the media as a hypodermic syringe, and the contents of the media were injected into the thoughts of the audience, who accepted the attitudes, opinions and beliefs expressed by the media without question. This model was a response to the German fascist’s use of film and radio for propaganda, and later applied to American capitalist society. The followers of the hypodermic model of Effects adopted a variant of Marxism, emphasizing the dangers of the power of capitalism, which owned and controlled new forms of media. Researchers in the fifties also supported the Effects model when exploring the potential of the new medium of television. Researchers were particularly concerned over increases in the representation of violent acts on television, which related with increases in violent acts in society. In the nineties, there was considerable concern over what were called "video nasties". The tabloid papers created a moral panic over whether particular violet films could influence child behavior – and whether Childs Play 3 influenced the child killers of Jamie Bulger, but there was no proof that they had watched it....

All teenagers around Hanna 2 the world have seen the movie and they weren't affected by It like Ben and Sarah ere; the problem seems to be in Ben and Sarah, not the movie. â€Å"1 500 hours of mostly violent TV programming might have slightly more effect on these two youngsters than two hours of Natural born killers? â€Å".Ben and Sarah could have never been affected by a two hours movie and motivated them to attempt a crime; as millions of people saw the movie and they never heard about somebody who attempted a crime from just watching a violent movie, as Natural born killers was not and won't be the last violent movie. The whole problem comes from the inner of Ben's and Sarah's, both of them had a bad life where the family was not there nor taking are of them or watching out their teenage children.We can tell that both of Sarah and Ben came out from a separated and different families where the love bond was not there; but they did share similarities in their personalities as both of them were drinking, doing drugs and as they don't have any source of Income eventually they will need money to continue living; That's what actually motivated them to attempt the crimes they did, not the movie. When a person is good and have pure thoughts his/her actions will be good and useful for others too, if that person is not, probably his/her actions will hurt others.And that is actually what happened with Ben and Sarah, both of them turned to be bad and do evil actions from what they sa w In their lives not from what the movie they saw. 1 OFF Using logical appeal was not enough to Oliver Stone clarifying and defending himself against Gresham, therefore he used ethical appeal; as Stone build up his argument talking about Gresham himself â€Å"A lawyer in search of a client could see in this an indictment of the entertainment industry and not of the teenage killers and those who reared them†.Oliver Stone trying to tell us that a lawyer who is Just looking for none and does not care about lives and the safety of people is not a person to trust; how can you trust a person who doesn't care about people lives and about how those teenagers had been raised up are not a responsible people. As we should care about this generation who's coming up to this world and help them to be better people for our country not to use them Just to get clients and make some money, Oliver here is trying to defend himself by blaming Gresham and everybody who's supporting those youngster s as it's not logical that.What can control a person ? A movie or the person himself !? How can Gresham blame a movie for attempting two murders ? Ben and Sarah are eighteen and nineteen years old, they are mature enough to control their actions and it's really a childish thing to blame a movie for motivating them to attempt two murder crimes one each. What gives a man a value than any others organism is the MIND which we can use to control our actions.Hanna 4 â€Å"If Dan White, the killer of San Francisco supervisor Harvey Milk and Mayor George Nosecone, could claim that Twenties made me do it† Oliver is continuing using ethical appeals by saying that a person can not do whatever he wants then blame it to other people or things and say that it was not his/her fault as somebody else or something motivated him/her to do a crime.Watching a movie is not the big thing that can motivate you, and if it's what about those people who are losing their families in the wars, and we nev er heard about any of them turned to be a murder, even us and our friends we all watch horror movies and play violent video games and it never turned us to violent people who can go and kill the others or even Jump into somebody else car and steal it, it is Just because there is no need to do that. But Ben and Sarah had their reasons to attempt the crimes but that is not an excuse to do a crime even when you have reasons.Artists should never be blamed for societal violence; in most cases, they are merely holding a mirror up to the reality that already exists or providing catharsis for emotions we are already suppressing. Violence is there and it does exist in the movies and we can not deny that but one who's watching is the one who decides what to do and how his/her actions will look like. It is a legal concept originating in Roman Civil Law, but it is essentially the equivalent of the double jeopardy (autrefois acquit) doctrine found in common law jurisdictions. – In dubio pro reo The principle of in dubio pro reo (Latin for â€Å"when in doubt, for the accused†) means that a defendant may not be convicted by the court when doubts about his or her guilt remain. It is often used specifically to refer to the principle of presumption of innocence that dictates that when a criminal statute allows more than one interpretation, the one that favours the defendant should be chosen. The Latin phase in dubio pro reo translates as in doubt, for the accused. A more expanded definition is that courts and  juries must take the side of an accused party when there are doubts about the charges. This is connected to reasonable doubt and to presumed innocence, which are a foundational part of many justice systems. That means Chinese citizens are having not enough disposable income to consume. The French government although utilizes preferential to attract investment, the Minimum Hourly Wage is the highest than China and the US. It will be greatly increased the cost of production. On the contrary, not only the US government provides favourable policy and huge consumer market, but also the appropriate R&D expenditure and reasonable scienti? research institutions.
